Munich courts rejects ECA and clubs requests‏

The request made by Euroleague was rejected

A Munich court has rejected a request by ECA and a number of clubs to order FIBA/FIBA Europe to issue a declaration that basketball clubs and leagues are free to participate in Eurocup. 14 parties, including Euroleague Commercial Assets (ECA) and the clubs of Fenerbahce, Real Madrid, Olympiacos and Maccabi, had filed a request for provisional measures before the Munich Civil Courts in May.


At first instance this was rejected and the judged asked for additional clarifications. After those were provided the judge rejected the part where the appellants were asking the court to order FIBA/FIBA Europe to issue a declaration that basketball clubs and leagues are free to participate in the competition of their preference.



The court has accepted a request that FIBA/FIBA Europe do not impose sanctions but, from a FIBA/FIBA Europe perspective, that matter has already been settled during the recent FIBA Europe Board in Dublin.



The 14 appellants: Fenerbahce,Real Madrid, Maccabi Tel Aviv, Olympiacos, Gran Canaria, Olimpija Ljubljana, Lietuvos Rytas, Cedevita, Unicaja Malaga, Zielona Gora, ABA league, ACB league, Euroleague Properties SA, Euroleague Commercial Asset.
